This September there will be a new legislation that aims to give head teachers a final say over the exclusion of unruly and disruptive pupils. The current system can force schools to take a pupil back if an appeals panel disagrees with the exclusion.
Under the new system a head teacher can override that decision and exclude the pupil anyway, but the school will have to pay £4,000 towards the costs of placing them at an another school.
Teacher unions complained about this new legislation because it could lead to unfairly penalizing schools with problem pupils.
The new regulations will apply to all maintained schools, Academies and pupil referral units.
Before I give my opinion about this piece I have to say that I had no idea what the rules of excluding pupils in the UK were before I read this article. I know what the rules are in the Netherlands and from that point of view it seems ridiculous that there even is an appeals panel.
Picture this:
A disruptive pupil is excluded from a school after two years of trying to get him to behave appropriately. He kept swearing and was very rude to the teachers, as a result the whole class thought this was the way to behave… Now the school has finally decided to exclude the pupil. The parents of this pupil do not agree and go to an appeals panel. The appeals panel does not agree with the school and forces the school to take the pupil back. The pupil knows he is not longer welcome at the school and his behavior only gets worse….
With the new legislation that could be avoided, but the school would have to pay to make the student go away….
I am not sure if any pupil would ever feel wanted by any school after this… they even paid thousands of pounds to get rid of you….!
